Wuhan Court Makes AI Production Costs a Legal Factor in Copyright Cases
Key Takeaways
- A Wuhan court included token usage and AI tool licensing fees in a copyright damages calculation for the first time.
- The dispute concerned a one-hour AI-assisted short drama copied, retitled, and monetized by another company within a day of publication.
- The court classified the drama as a protectable audiovisual work because employees made creative decisions at every stage, treating AI as a tool.
- Traditional factors such as runtime, distribution reach, and infringement duration were also weighed alongside the AI production costs.
